Right of Withdrawal

Right of withdrawal

The Customer who is also a “Consumer” has the right to withdraw from the contract concluded with Design Alpino, without any penalty, by paying only the transport costs. The Customer who does not have the qualities of “Consumer” cannot withdraw from the contract; the same principle applies to the Customer who has provided his VAT number at the time of the order, meaning this indication as a willingness to purchase the goods for purposes related to the professional activity carried out. The right of withdrawal must be exercised within fourteen working days, starting from the day following that on which the “Consumer” received the goods, in writing. In the case of separate delivery of several goods, ordered by the Consumer Customer with a single order, the fourteen-day term for exercising the right of withdrawal starts from the day on which the last good is delivered. Within the aforementioned 14-day period, the Consumer Customer must communicate the intention to withdraw from the contract by sending the standard form compliant with annex B of Legislative Decree 21/2014 available at this link in pdf version via email at shop@designalpino.it. The notice of withdrawal must specify the intention to withdraw from the purchase (it is not necessary to specify the reasons) and the Product or Products for which you intend to exercise the right of withdrawal, attaching a copy of the documentation proving the purchase. Deign Alpino will communicate to the Consumer Customer a confirmation of receipt, via e-mail to the e-mail address communicated during the purchase procedure on the Site, of the withdrawal exercised. In compliance with the provisions of article 59, lett. c) and d) of the Consumer Code, the Consumer Customer cannot exercise the right of withdrawal for Products made to measure or clearly personalized or which are likely to deteriorate or expire rapidly. The right of withdrawal is also excluded in the following cases:

  1. the returned item is not intact
  2. the article is a painting or an artistic artefact
  3. the item is returned without the original packaging and/or all the accessories originally contained in the package
  4. partial withdrawal, understood as a withdrawal limited to a part of the sold item which forms a substantial and inseparable unit with it
  5. the item is not returned to Design Alpino

It should be noted that the return can be made in a shop other than the one of the purchase. If the Product was purchased online, it will be possible to go to our showroom in Sause D’Oulx or to the design office in Turin and return it directly. Products purchased online with home delivery may be returned to the showroom and design office, only following the right of withdrawal.

Simultaneously and within the same term for exercising the right of withdrawal (fourteen working days from the date of receipt of the article by the Consumer), the Consumer is required to return the delivered article to Design Alpino. The transport costs, none excluded, relating to the return of the item remain the exclusive responsibility of the Consumer who has withdrawn from the contract, as provided for by article 57, paragraph 1, of the Consumer Code. The Customer can freely choose the Courier to whom to entrust the return of the goods. Design Alpino, as unrelated to the relationship between the Customer and the Courier, is not liable for any damage to the returned products that occurred during the transport journey, which therefore remain at the Customer’s total and exclusive risk and responsibility. Design Alpino, in order to allow the Customer to protect his rights against the Courier, will promptly inform the Customer that the goods have been returned damaged and that he is at his disposal for any checks. In this case, the Customer will have to bear the transport costs and will have no right to a refund of the amount paid for the withdrawal not being effective (having been returned a non-intact product). Similarly, Design Alpino is not liable for any loss or theft of returned products, which occur during the transport journey, which remain at the total risk and responsibility of the Customer. Even in this case, the Customer will not be entitled to any refund of the amount paid, as the withdrawal is not considered effective.

If the right of withdrawal has been exercised by the Consumer in accordance with all the above provisions, Design Alpino undertakes to reimburse the sums paid by the Consumer, within thirty days following the date on which Design Alpino became aware of the exercise of the right of withdrawal by the Consumer. If, on the other hand, the methods, conditions and terms for exercising the right of withdrawal, as specified in this article, are not respected, the Consumer Customer will not be entitled to a refund of the sums already paid. In this case, the Consumer Customer will be able to get back, at his expense, the Product in the state in which it was returned to Design Alpino. Otherwise, Design Alpino will be able to keep the returned Products, in addition to all the sums already paid by the Consumer Customer for the relative purchase. Shipping and transport costs are charged to the customer.

The refund will take place within 30 working days from the return of the goods and will take place through the reversal procedure of the debit transaction if the payment was made with PayPal or by bank transfer if the payment was made with advance bank transfer or credit card. In the latter case, it will be the customer’s responsibility to provide in writing (e.g. also in the same Withdrawal communication), the bank details on which to obtain the refund (IBAN code and name of the account holder). If there is no correspondence between the recipient of the products indicated in the order form and the person who paid the sums due for their purchase, the refund will in any case be made to the person who made the payment.

Alpine Design reserves the right to withhold the refund until it has received the Products subject to the right of withdrawal, or until the Consumer Customer has demonstrated that he has returned the goods, depending on which situation occurs first.
